1. Who we are

2. These terms

These terms apply to every order you place through this website. By placing an order you agree to them, so please read them. They don’t affect your statutory rights as a consumer.

3. Age

It is an offence to sell alcohol to anyone under 18. By ordering you confirm that you are 18 or over, and that the person receiving the delivery will be 18 or over. Our courier operates a Challenge 25 policy and may ask for photo ID; if no adult is available to sign, the parcel will not be left. We may refuse or cancel any order where we cannot be satisfied of the buyer’s age.

4. Placing an order

Your order is an offer to buy. We accept it, and a contract is formed, when we email you to confirm dispatch. Before then we may decline an order — for example because of a pricing or stock error, because we can’t deliver to the address, or for the reasons in section 3 — in which case any payment taken is refunded in full. Payment is taken at the time of ordering through our payment provider, Stripe; we don’t see or store your card details.

5. Prices and payment

Prices are in pounds sterling and include VAT at the current rate. Delivery charges are shown before you pay. If we discover an obvious pricing error we will contact you before dispatch and you may cancel. Discount codes can’t be combined unless we say otherwise, and we may withdraw them at any time.

6. Delivery

We deliver to UK mainland addresses by tracked courier. Dispatch and delivery times on the delivery page are estimates. The goods and the risk of damage or loss pass to you when they are delivered to the address you gave us. Breakages must be reported within 48 hours with a photograph.

7. Your right to cancel

As a consumer you have the right to cancel this contract within 14 days, without giving a reason. The period ends 14 days after the day you (or someone you nominate) receive the goods. To cancel, tell us clearly by email, or use the form at the end of these terms. If you cancel, send the goods back to us within 14 days, unopened and with the seal intact. You pay the cost of return. We will refund the price of the goods and the basic delivery charge within 14 days of receiving the goods back (or of your proof of posting). Sealed goods that have been unsealed after delivery cannot be returned, for health and hygiene reasons.

8. Faulty goods

Nothing in these terms affects your rights under the Consumer Rights Act 2015. If a product is faulty, not as described or damaged when it arrives, contact us and we will replace it or refund you, including reasonable return costs.

9. The product

Gouté Balvin is a natural product blended in small batches; colour and character can vary slightly between batches. Ingredient, allergen and alcohol information is printed on the label and shown on the product page. If you have a specific allergy or dietary concern, contact us before ordering.

10. Our liability

We don’t exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud. Otherwise, our liability to you in connection with an order is limited to the price you paid for it, and we are not liable for loss that was not foreseeable, or for business losses. Please drink responsibly.

11. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control. If one happens, we will tell you and do what we can to reduce the delay; if the delay is substantial, you may cancel and receive a refund for goods you have paid for but not received.

12. Privacy

We use your personal information as described in our privacy policy.

13. Complaints, law and disputes

If something has gone wrong, email us first — we would rather fix it. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, except that if you live in Scotland or Northern Ireland you may bring proceedings in your local courts.

14. Changes

We may update these terms from time to time. The version on the website when you order is the one that applies to that order.
